Terms & Conditions (AGB)
These general terms and conditions apply to all equipment rental contracts between [Company name] and its customers.
This text is a draft
The fields in square brackets have not yet been filled in with the company details. Until the text is finalised it is not binding; please contact us if you have any questions.
1. Scope
These terms apply to every rental relationship entered into via this website or by direct contact. Deviating terms of the customer only apply if we have accepted them in writing.
2. Conclusion of contract
The presentation of items on this site is not a binding offer but an invitation to make one. By submitting the order form you send us a binding rental request; no contract is concluded at this point.
The contract comes into existence when we send you the e-mail confirming your request. We reserve the right to decline a request; a rejection is likewise sent by e-mail and no charge arises.
3. Prices and currency
Prices are set in euro (EUR) and, unless stated otherwise, refer to the daily rental rate. Amounts shown in Turkish lira are indicative conversions based on the European Central Bank rate; the euro amount is the one that is invoiced.
Delivery, set-up, dismantling and transport are charged separately and are itemised in the confirmation e-mail. Statutory VAT is [included / excluded].
4. Rental period
The rental period starts on the agreed set-up date and ends on the agreed return date. If the equipment is returned later than agreed, the daily rate is charged for each additional day.
The period may only be extended subject to availability and by written agreement.
5. Delivery, set-up and return
The equipment is delivered to the agreed address or collected by the customer. The customer is responsible for providing suitable vehicle access at the delivery location and, where required, a power supply.
The customer must inspect the equipment on handover. Obvious defects must be reported at handover and hidden defects immediately after they are discovered.
The equipment must be returned in the same clean and complete condition in which it was handed over; otherwise cleaning and repair costs will be charged.
6. Security deposit
Depending on the value of the equipment, a security deposit of [amount / percentage] may be required. The deposit is refunded within [number] days of the complete and undamaged return of the equipment, less any costs for damage or missing items.
7. Obligations of the customer
- To use the equipment only for its intended purpose and in accordance with the technical instructions
- Not to pass the equipment on to third parties, sublet it or move it away from the agreed location
- To protect the equipment from the weather and from theft and to store it securely when not in use
- Where set-up and dismantling are performed by us, not to interfere with that work and to provide the necessary access
- To report damage, malfunction or loss without undue delay
8. Damage and loss
During the rental period the customer is liable for loss and theft of the equipment and for damage that goes beyond normal use. Repairable damage is charged at the cost of repair; irreparable damage or loss is charged at the replacement value.
Wear and tear resulting from ordinary use is not charged to the customer.
9. Insurance
Insurance of the rented equipment during the rental period is [provided by us / the responsibility of the customer]. Losses that fall outside the scope of the insurance are borne by the customer.
10. Payment
Payment is made using the method and within the period stated in the confirmation e-mail. Unless agreed otherwise, the full amount is due before handover.
In the event of late payment, statutory default interest applies; we reserve the right to withhold the equipment until payment has been received.
11. Cancellation
The reason for this period is that crew, vehicles and equipment are scheduled around the set-up date and the items are blocked for other customers on that date. Once the final three days begin, this planning can no longer be changed.
A cancellation must be sent to us in writing (an e-mail is sufficient); the deadline is calculated from the moment your request reaches us.
If you prove that the actual loss was lower, only the proven amount is charged. Equally, we reserve the right to prove a higher loss.
As the equipment is rented for a specific date, the exception to the 14-day right of withdrawal for distance contracts applies; see our Right of Withdrawal page for details.
- More than 3 days (72 hours) before the set-up date: cancellation is free of charge.
- 3 days (72 hours) or less before the set-up date: the order is binding, cannot be cancelled and the full rental price becomes due.
12. Force majeure
We are not liable where performance is prevented by unforeseeable events beyond our control, such as natural disasters, official bans, strikes or power failures. In such cases any payment received is refunded and no further claims for compensation arise.
13. Limitation of liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise, in cases of slight negligence, our liability is limited to the breach of essential contractual obligations and to the foreseeable damage typical for this type of contract.
14. Governing law and place of jurisdiction
This contract is governed by the law of [applicable law, e.g. Germany]. Mandatory consumer protection provisions of the country in which the consumer resides remain unaffected.
For disputes between merchants the place of jurisdiction is [competent court / city]. Should any provision be invalid, the validity of the remaining provisions is unaffected.
